Am I eligible for statutory maternity or paternity pay?

Here is the eligibility criteria, set by HMRC, for Statutory Maternity Pay and Statutory Paternity Pay.

  • You need to have worked continuously for at least 26 weeks continuing into the ‘qualifying week’ – which is the 15th week before the expected week of childbirth. The 26 weeks period is referred to as the ‘qualifying period’.
  • You need to earn on average at least £118 a week for the qualifying period.
  • You need to have given the correct notice to your employer. You need to have told them at least 15 weeks prior to the baby’s due date when the baby is due.  You must also give 28 days notice of your intended leave date or for paternity pay confirm you will be taking 1 or 2 weeks leave.
  • You need to have given your employer proof of your pregnancy – usually a MATB1 certificate or a letter from your doctor or midwife.
